DUI Penalties in the State of Tennessee
While each case is different and depended on the discretion of the judge, if convicted for DUI in the state of Tennessee, you face the following kinds of penalties:
- First DUI: fines are $350 - $1,500, 48 hours to 1 year in jail, revocation of your license for 1 year, may be ordered to install ignition interlock device at a minimum cost of $810 a year, and enrollment in drug or alcohol program if the judge so orders.
- Second DUI within 10 years of First DUI: a mandatory fine between $600 and $3,500, 45 days to 1 year in jail, license revocation for 2 years - restricted license available only after first year of revocation, DUI school mandatory, vehicle may be seized, and you may be ordered to install an ignition interlock device.
- Third DUI within 10 years of First DUI: mandatory fines between $1,100 and $10,000, 120 days to 1 year in jail, license revocation between 3 and 10 years with no allowance for a restricted license, possible vehicle seizure, and installation of ignition interlock device at the discretion of the judge.
- Felony DUI - four or more DUIs within 10 years of First DUI: a mandatory fine between $3,000 and $15,000, 1 year in jail with a minimum of 150 consecutive days served, license revocation for 5 years with no allowance for a restricted license, vehicle subject to seizure, and mandatory DUI school.
Some of these DUI penalties can be increased if you have a blood alcohol content (BAC) of .20 or higher, have a minor in the car with you at the time of your DUI arrest, or cause an accident that involves injuries or fatalities.
